The New Zealand government has just announced new measures to tax capital gains and to impose new lending restrictions on residential property, taking aim at property speculators.  These new measures will take effect from 1 October, 2015.  For details, please read the following articles.

昨天本國總理宣佈由本年十月開始實施一系列措施以開徵住房增值利益,用以打擊那些投機及外國買家,藉此壓抑短線炒風。

該一系列措施的重點如下:

•  過往的法例規定,若你買房是志在賺取房産增值利益的,該利益所得是要繳税的。但現在這法例不單只繼續執行,並且新增另一條法例,就是若你在購買住房或住房用地後二年內轉售,你從售賣中賺取的增值利益是要繳入息税的。

•  若你售賣的是自住房、繼承房產或因離婚原因而必需出售的房産均可獲豁免。

•  你不能因超過二年後才賣房而以為可避過上税,因國税局會按現行的意圖法例去决定你是否投機炒作而追税的。

•  非本土買家(包括那些非紐西蘭税網人仕及在海外生活的紐西蘭人)必需跟本土居民一樣按住房增值利益上税。

•  非本土買家必需提供(a) 紐西蘭稅號、(b) 原居地税號及(c) 纽西蘭銀行户口。

Prime Minister John Key announced yesterday that from October, there are new measures to tax capital gains on residential property will help weed out speculators and foreign investors who trade Kiwi homes just to turn a quick buck. 

To summarize:

•  At present, if someone buys a property with the 'intentions' of making capital gain, the profit is taxable.  That rule remains but an additional rule says that the capital gain on any sale of a residential property (that includes sections) within two years of purchase will be subject to income tax.

•  There are exemptions for the seller's main residence, inherited property and property that is sold as part of a relationship settlement.

•  As the existing intention law will remain, therefore it means that property speculators cannot just delay their sales to shortly after two years.

•  Non-resident property buyers (including those who is not a New Zealand tax residents and who may be a New Zealanders living abroad) are subject to and will be subject to the same rules on capital gain as New Zealand buyers.

•  Non-resident buyers have to provide (a) a New Zealand IRD number, (b) their tax ID from their home country and (c) a New Zealand bank account.

儲備銀行宣佈對買奧市出租房的投資買家作規管;他們必需提供三成首付,但買奧市外的制管則被放寬 (RBNZ announces LVR restrictions for Auckland rental property investors; they must have at least 30% deposit; LVR relaxed outside of Auckland)

本國儲備銀行宣佈從本年十月起奧市出租房的投資買家向銀行申請房貸時必需提供30%首付,此擧用以煞慢奧市不斷上升的房價。

但對於購買新建房,則不在此管制之列;若購買奧市外的房產,銀行會放寬借貸的比率。

The Reserve bank has announced new rules from October that Auckland rental property investors must have a deposit of at least 30% in a sweeping new escalation of its measures to try to slow house price inflation in Auckland. 

However, the bank has eased the current Loan to Value Ratio (LVR) restrictions for property buyers outside Auckland and has exempted new builds from the new restrictions on Auckland rental property buyers.

自2007年以來奧市房價已上升超過25% (Over 25% increase in Auckland home values since 2007)

QV本月的住房房價指數顯示全國的住房房價亦已上升了; 奧市住宅的房價急速上升,除去季節性調整後,現時市內的房價已較往年上升了14.5%,而且較2007年的高峯更超出27%。

QV 的發言人稱,漢密頓、陶朗加、威靈頓及基督城的房價均保持平穩的漲幅,但奧市房價郤急劇上升,有些地區自十一月以來已錄得雙位數字的升幅。他續稱,數據也顯示奧市的平均房價已突破$800,000關口,現在達到$809,200。

該發言人續稱,奧市房價在2015年房價將持續上升,這要歸咎於高增長的淨流入移民人數達到54,000人,其中半數將會定居奧市。在這個超級城市中,南區包括Blockhouse Bay, Sandringham, Otahuhu 及Onehunga的房價上升幅度最高。奧市的外圍地區如Waikato(包括漢密頓)和陶朗加也錄得房價上升的勢頭;QV的估價師稱這是奧克蘭效應,因奧市居民開始向外圍推移,以尋找更物有所值的住房。

According to this month’s QV Residential Price Movement Index, nationwide residential property values have also gone up.   Rapidly rising Auckland residential property values mean that, when adjusted for inflation, the city’s values have increased by 14.5% over the past year and are now 27.0% above the 2007 peak.

QV national spokesperson Andrea Rush said, “While Hamilton, Tauranga, Wellington and Christchurch have continued to show a steady, moderate rise in values, Auckland has continued its rapid rise, with many areas seeing double digit increases in values since November.”  Rush said the index data showed that the Auckland region’s average value has cracked the $800,000 mark: it is now $809,200.

“With net migration at a record 54,000 and still rising and 50% of migrants moving to Auckland, home values in the Super City are likely to remain high and keep rising during 2015.”  Auckland’s values were led by big increases in Auckland City-South – which includes suburbs like Blockhouse Bay, Sandringham, Otahuhu and Onehunga.  Outside of Auckland, parts of the Waikato (including Hamilton) and Tauranga recorded value increases.  QV valuers from these areas said this was partly due to the “Auckland effect” – whereby Aucklanders look outside the Super City region for areas where they can get better value for their money.


財長稱要增強IRD資源以厲行物業税法列 (Boosting IRD resources to enforce property taxes a possibility - English)

本國財長Bill English表示,引入資產增值税將不會放在議題上,但會討論如何增加IRD資源在現行税法下去調查物業交易個案。

財長稱他們會繼續討論應否給予IRD額外資源去更深入地調查那些物業投機及炒賣的情况。他表示,"我認為每一個人包括地産仲介及買家現正熱衷於奥市的房產炒賣活動,這引申了一個問題就是我們是否要加强執法。現在的重點是IRD需要何種資源去輔助他們加强執法呢?這將會在預算案中討論。"

大家可能不理解到,本國現有的稅務框架下已包括有向那些炒賣房產以謀取利益的人徵收税款,這亦涵蓋那些重裝物業後再轉售的人。

Introduction of a capital gains tax is not on the agenda, but increased resources for the IRD to investigate property deals under the existing tax legislation is, according to Finance Minister Bill English.

English said there was ongoing discussion about whether the IRD should be given additional resources to investigate property speculation and trading more comprehensively.  "I think everyone - real estate agents, buyers - are pointing to higher levels of trading activity in Auckland and so there is a question of whether that should give rise to further enforcement activity.  The focus is on what resources they might need for further enforcement of existing law and that will be a matter discussed in the context of the budget.”

Contrary to popular perception, New Zealand’s tax framework already includes a tax on people who buy properties with the intention of reselling for profit.  This includes people who buy properties to renovate and resell.

投資者認為奧市房産值被高估了 (Investors think Auckland property is overvalued)

最新的Crockers房產投資指數指出,有59%受訪的房產投資者認為奧市的房產價值被高估了,當中21%更認為該等房産值被高估超過20%。

Crockers 發言人稱這個調查結果顯示投資者對房價抱持審慎態度,故此有63%的受訪投資者表示他們暫不會有任何入市舉動。祗有五分之一的受訪者正打算購房,而18%正打算賣房。從當中可以看到,雖然需求較供應強些,但供求仍算處於均衡水平。

該發言人續稱,以往人們衝動購房導致房價飈升,現時投資者顯得較為審慎。她認為今時的房價似乎受着一些整體因素影響包括新移民定居奥市的人數、首置買家及外國投資者等。

有趣的是,調查報告更發現人們購買公寓的意欲不斷增加,這似乎説明了投資者及首置買家均認為購買公寓是一個較合乎經濟的選案。

該調查報告跟受訪的投資者探討他們對儲備銀行草擬修改投資房產的貸款規條的看法時發現,有超過37%的受訪者認為這會嚴重影響著他們的融貸渠道,另有27%認為這會促使利率上調,有17%認為這會廹使他們向其他途逕借貸,祗有12%以為這會變相地不鼓勵投資者壯大他們的房産規模。
Crockers 發言人稱這似乎反映了大多數投資者的心態,就是一動不如一靜。

Over half (59%) of property investors surveyed for the latest Crockers Property Investment Index think that Auckland properties are overvalued – while 21% of them think they are more than 20% overvalued.

Kim Sinclair, from Crockers Property Group, says the results of this month’s survey indicate that many investors are taking a cautious approach to property prices.  She says this is further supported by the fact that 63% of investors surveyed are not planning to change their current portfolio stock in any way.  Just under a fifth of those surveyed are currently looking to buy, while the remaining 18% are currently planning to sell.  This indicates a fairly balanced supply and demand situation, although demand does slightly outstrip supply, Sinclair says.

In her view, this more cautious investor behaviour sits in opposition to anecdotal tales of emotionally-based activity driving property prices.  “Rather I would say that prices are probably being driven by a combination of migration numbers settling in Auckland, first home buyers and foreign investors.”

Interestingly, Crockers market data also shows that interest in apartments has grown.  Sinclair says this can probably be put down to apartments being a more cost effective option for investors and first home buyers.

The Crockers survey also asked investors about their views on the potential impact of the Reserve Bank’s proposed changes to investment property lending rules.  Over a third (37%) of those surveyed think the greatest impact would be a restriction of fund availability for investors, while 27% think the greatest impact would be an increase in interest rates (27%).  Seventeen percent think they would be forced to borrow from alternative sources, but only 12% think it would discourage investors from owning large numbers of investment properties.

Sinclair says this probably reflects the main intention of the majority of the investors interviewed - which is to “sit” on their properties without further purchases.

It’s a sellers’ market out there - according to new data from Realestate.co.nz which shows that prices continue to rise and listings fall.

Realestate.co.nz’s latest monthly data shows that, in March, the average asking price in New Zealand reached a new high of $514,712.   This was a small increase of 0.6% on the previous record of $511,412 set last month, and the third consecutive month of record asking prices.  The data also showed that the number of new listings in March was 11,870, which is a decline of 4.9% from the same time last year, and the lowest for March since 2009.

Realestate.co.nz CEO Brendon Skipper says the growth in asking prices in March was also reflected in different parts of the country with three regions (Auckland, Canterbury and Wairarapa) hitting new records.  Canterbury’s new high of $467,126 was a 1.3% increase from the previous record of set in July 2014, while Auckland’s new high of $766,912 was a 0.3% increase from the record high set last month.

 “With the slight fall in the number of new listings in March, sellers are in a good position to maximise the value of their homes.”  Nationwide, the number of new listings of homes for sale in March was 11,870.  This was a decrease of 4.9% from the March 2014 and a fall of 1.1% on the 12,008 new listings in February.  It is the lowest number of new listings recorded for the month of March in six years.
